Discriminatory Act Targeting Life-Affirming Maternal Health Ministries Immediately Halted

(3 August 2023 – Rockford, Illinois) At a hearing held on 3 August in the United States District Court, a federal judge granted a motion requested by attorneys representing Thomas More Society for a preliminary injunction, which sought to immediately halt the enforcement of Illinois’ new law that attacks life-affirming maternal health care centres. The lawsuit, National Institute of Family Life Advocates et al. v. Raoul, asserts that this law—enacted on 27 July 2023, and amending the Consumer Fraud and Deceptive Business Practices Act—was designed to target pregnancy help ministries solely because of their pro-life message.

In a victory for free speech, pro-life advocates across Illinois can now rest assured that they will not be subjected to prosecution for disseminating what they consider to be accurate information. This assurance was provided by Peter Breen, Executive Vice President and Head of Litigation for the Thomas More Society. Mr. Breen argued the case on behalf of the National Institute of Family Life Advocates and other pro-life ministries, including pregnancy care centers in Illinois.

“Across the nation, pregnancy help ministries are being subjected to discriminatory legislation that targets their life-affirming work,” stated Breen. The injunction granted today serves to reinforce the message that the First Amendment protects pro-life speech.
