PAIN CAPABLE UNBORN CHILD PROTECTION ACT

Kansas no longer allows abortions for unborn children who feel pain. The only exception is if the mother’s life is in danger. (HB 2218)

ABORTIONS & PARENTAL RIGHTS

In Kansas, girls under 18 must get their parents’ permission for an abortion. Some exceptions apply to single parents or couples who aren’t married. The court can’t just rubber-stamp the girl’s claim that she’s mature enough or that involving her parents is against her interest. The bypassing judge may do more evaluation and must report suspected child abuse. The pregnant woman and her family can sue for illegal late-term abortions. (HB 2035)

ABORTION FACILITY LICENSURE

Kansas hospitals, surgical centers, and private offices that do elective abortions must get an annual license. Each abortion must be done by a state-licensed physician with local hospital privileges. Abortions by pills must be done in person. An ultrasound is required before an abortion. The woman can get a copy of the image. (H Sub SB 36)

INSURANCE & ABORTION

Private health insurance may not provide coverage for abortions, except in cases where the life of the mother is at risk. Insurers may offer riders for abortion coverage, which can be purchased separately. Kansas has a policy of excluding abortion coverage from future “Obamacare” health exchange plans, scheduled for 2014 (HB 2075).
