Indiana Right to Life applauds state for appealing Judge’s recommendation to allow proposed abortion site in South Bend

INDIANAPOLIS – Indiana Right to Life’s President and CEO, Mike Fichter saluted the state of Indiana for appealing an administrative judge’s recommendation on the proposed abortion facility in South Bend, Ind.  He said

We applaud the state of Indiana for continuing the legal effort to prevent an abortion business from opening in South Bend. We encourage the state to vigorously defend its denial of the license. Activist courts should not be overriding the state’s right to make licensing decisions.”

By appealing, Whole Woman’s Health Alliance (WWHA) will remain without an abortion license to operate in South Bend, but the legal battle will continue.

The State of Indiana denied WWHA’s application for an abortion license in January. The denial letter stated: “Based upon the Department’s review, the Commissioner finds WWHA failed to meet the requirement that the Applicant is of reputable and responsible character and the supporting documentation provided inaccurate statements and information.”

Last month, Indianapolis-based administrative law judge, Clare Deitchman, sided with WWHA in their bid to open a new abortion facility and recommended they receive an abortion license.
