Two days after the Supreme Court of India gave a 13 year-old rape victim legal permission to abort her 32-week-old unborn baby, she unexpectedly gave birth today via C-Section to a 4 pound baby girl who reportedly is in neonatal intensive care.
“The baby is stable and will be under observation,” said Dr. Ashok Anand, a gynaecologist at the hospital,” according to Tabassum Barnagarwala. “The minor will remain in hospital for a week.”
None of the early accounts explain why the abortion was not performed. The alleged rapist is the father’s business partner.
Further complicating the entire tragedy was that an abortion that close to natural birth is extremely dangerous to the mother. Typically, the process of taking the child’s life in those instances extends over three to four days.
The case of this young girl from Mumbai comes on the heels of a case of a 10-year-old girl, also a victim of rape, whom the courts did not give permission to abort. The girl delivered her baby by C-section after the Supreme Court of India said that 32 weeks, she was too far along, reasoning that the abortion was far too dangerous for the girl.
The 13-year-old’s pregnancy was not discovered until August
when her parents took her to a doctor to check whether her sudden obesity was caused by thyroid, a sonography showed she was 27-weeks pregnant. Police said till then she had not informed her parents about the assault.
On August 9, the parents of the 13-year-old registered a police complaint with Charkop police. According to police, the 23-year-old accused, who allegedly assaulted the minor multiple times, has been arrested.
The latest story, posted by News Nation while not the model of clarity, could be read to suggest doctors were trying to induce premature labor, rather than perform an abortion.
Permission for the abortion was granted on Wednesday on the grounds that the girl had been traumatized and that the risk of pregnancy was equal to the risk of having an abortion.
However, the doctors had suggested that the abortion should take place after two weeks as they wanted foetus to grow further but the court ordered an immediate termination as the girl was going through severe trauma.
A lawyer for the girl’s family told CNN that the girl’s parents are making an adoption plan for the baby.
