An Italian couple, who live in Alessandria, in north-west Italy, is again suing because a hospital “failed” to abort their child, who is now a teenager. Only this time it is the father, rather than the mother.
The mother of the unidentified couple had already “received a settlement from the hospital because the birth had had economic repercussions on the family,” Hannah Roberts of the Daily Mail reported.
Then, in 2008, the father went back to the courts, arguing his daughter’s unwanted birth had caused him “psychological damage.”
Roberts reported that the father has already lost twice in lower courts but that the case would now be heard by the Italy’s highest court.
According to the Daily Mail, in 2001, the couple discovered the mother was pregnant during the diagnosis of a cyst. Already the parents of a son, they decided to abort the baby.
However the attempted abortion “failed” and by the time this “mistake” was discovered, it was past the point where the mother could have an abortion under Italian law.
“A court in Alessandria rejected the request [for psychological damages] as did an appeal court saying that it was not shown that the man really did want an abortion,” Roberts reported.
