A man who aborted his then-girlfriend’s 13-week-old unborn child by slipping her an abortifacient has been sentenced to 4.5 months to two years in prison, and will pay a $1,000 fine.
Orbin Tercero, 39, had pleaded guilty in January in Bradford County (Pa.) Court to performing an abortion without a license and tampering with evidence, according to John Wick of the Steuben Courier. His plea “came less than a week before he was set to go on trial on multiple homicide and other charges,” according to Zick. “He could have faced life in prison if convicted of the most-serious charge, murder of an unborn child.”
Tercero had since married the woman who is pregnant with their child. “We were concerned about how the personal situation would be regarded by the jurors,” District Attorney Daniel Barrett said. “But the guilty plea to the felony and misdemeanor were consistent with our objectives in the case.”
Tercero had worked as a pharmacist at several food stores. Prosecutors charged him with inserting a drug thought to be Misoprostol into his girlfriend during two sexual encounters early last year. (According to Zick, Tercero also allegedly put the drug in her juice and water.)
The second time—February 28, 2011—she aborted her baby at Robert Packer Hospital in Sayre, Pennsylvania. The baby was 13 weeks gestation.
At the time Tercero was engaged to another woman.
“Judge Jeffrey Smith said the sentence would allow Tercero to see his son, who is in seventh grade, and his unborn child,” reported Sara Sultanik of WETM-TV. “Tercero’s wife Amy is expecting a baby boy in July.”
